An Invitation to Fraud

The Obama administration has now declared that the Affordable Care Act is not a federal health care program, so the federal anti-kickback law doesn’t apply to it. That means rebates, kickbacks and bribes will be perfectly legal.

I thought it was bad enough that last July the Health and Human Services Department announced it won’t be able to verify eligibility for people asking for insurance subsidies. In 2014, at least, it will let the applicants themselves decide if they are eligible. The Administration argues that the fear of later audits will keep applicants honest. How could we doubt it?

According to the Wall Street Journal, “The Treasury Inspector General estimates that 21% to 25% of Earned Income Tax Credits go to people who aren’t eligible. An equivalent rate of fraud in ObamaCare could mean $250 billion in bad payments in a decade.”

Yuck!
